- Effective date: [EFFECTIVE DATE]
1. Agreement
By downloading or using Nasty Alarm ("the app") you agree to these Terms and to our Privacy Policy (https://nastyalarm.com/privacy.html). If you do not agree, do not use the app. Your use of Google Play is also governed by Google's own terms.
2. Minimum age
You must be at least 16 years old to use the app. By using it, you confirm that you are 16 or older.
3. What the app does
Nasty Alarm is an alarm clock that makes you complete wake challenges (math, typing, memory, sequence, and a cartoon-video quiz) before you can turn off an alarm. Signed-in users can join "Crews" of friends and see each other's morning status (awake, ringing, or sleeping). [PLANNED: Friends can send each other wake requests through push notifications.]
4. Alarm reliability – important
We work hard to make alarms ring on time, but we cannot guarantee that an alarm will always ring. Alarms depend on your device and its settings, for example battery optimisation, manufacturer restrictions (such as Xiaomi autostart), Do Not Disturb, volume, a powered-off or dead phone, operating system updates, and the permissions you grant. Do not rely on the app as your only alarm for anything important, such as exams, flights, work shifts, or medication. Please test your alarms and grant the permissions the app asks for.
5. Wake challenges – use safely
The challenges are designed to wake you up. Do not use the app in a way that is unsafe for you or others (for example, while driving). Stop using a challenge if it causes discomfort. The app is not a medical or health product.
6. Your account
- You sign in with your Google account. You are responsible for activity on your account and for keeping your Google account secure.
- You can delete your account at any time: see https://nastyalarm.com/delete-account.html.
- Your display name [and profile photo] and morning status are visible to your crew members[ and other signed-in users – CONFIRM, see Privacy Policy section 4].
7. Crews and acceptable use
When you use Crews [and wake requests], you agree not to:
- harass, spam, or repeatedly send unwanted wake requests to other users;
- use an offensive, misleading, or impersonating display name;
- share invite codes publicly in order to let strangers into crews;
- try to access other users' data, reverse engineer or interfere with the app or its servers, or get around its security or limits;
- use the app for anything illegal.
We may remove content, leave or remove crews, or suspend or delete accounts that break these rules. To report abuse, email support@nastyalarm.com.
8. (PLANNED) Ads
The free version of the app may show ads. Ads are provided by third parties, and we are not responsible for advertisers' products or websites.
9. (PLANNED) Paid features and subscriptions
- Purchases are made through Google Play Billing and are subject to Google Play's terms. Prices are shown in the app or on Google Play before you buy.
- Subscriptions renew automatically until you cancel them. You can cancel at any time in Google Play (Payments & subscriptions). Cancelling stops the next renewal; you keep access until the end of the current paid period.
- Right of withdrawal (EU/UK consumers): for digital content and services you normally have a 14-day right of withdrawal. If you ask for immediate access and acknowledge that you lose this right once delivery starts, the right of withdrawal ends when the content is provided. [Drafting note: the purchase flow must actually ask for this consent and acknowledgement; confirm how Google Play handles it for your products.]
- Refunds are handled under Google Play's refund policy, and nothing in these Terms limits any refund rights you have under the law.
- If we stop offering a paid feature you have paid for, we will [give you a pro-rata refund / continue to provide it until the end of the paid period – DECIDE].
10. Intellectual property
The app, including its code, design, sounds, videos, and text, belongs to Ashka Po or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Android devices you own or control, for your own non-commercial use. [CONFIRM: list third-party content licences (sounds, videos, fonts) and open-source licences, e.g. on an in-app "Licences" screen.]
11. Changes and availability
We may update, change, or discontinue the app or any feature. We may change these Terms; for important changes, we will notify you in the app. If you continue to use the app after the change, you accept the new Terms.
12. Ending your use
You can stop using the app at any time and delete your account. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections 4, 10, 13, and 14 continue to apply after your use ends.
13. Disclaimer and limitation of liability
- The app is provided "as is" and "as available", without warranties beyond those required by law.
- To the extent permitted by law, we are not liable for indirect or consequential loss, including loss caused by a missed or late alarm (for example, missing an exam, a flight, or work), or for loss of data.
- If we are liable to you, our total liability is limited to the amount you paid us for the app in the 12 months before the claim [or EUR 50 if you paid nothing – CONFIRM].
- Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for intent or gross negligence, for death or personal injury caused by negligence, or your mandatory rights as a consumer in your country of residence (for example, under EU consumer law, the Australian Consumer Law, or Canadian provincial consumer law).
14. Governing law and disputes
These Terms are governed by Dutch law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. Otherwise, disputes go to the competent court in [CITY], the Netherlands. Please contact us first at support@nastyalarm.com so we can try to solve the problem informally.
